What is the Workers' Compensation System?

Every employee is normally protected under workers' compensation laws, no matter what your career may be. The workers' compensation system is designed to quickly compensate employees when they are injured during working hours. It is important to note that filing a workers' compensation claim is not a "lawsuit" against your employer. In fact, the law does not allow an employee to sue their employer for negligence. Every employer is required to have workers' compensation insurance to protect employees in the event they are injured while working. Every work injury is covered under workers' compensation law, even if the injury was your own fault. 

Benefits Employees are Entitled to in a Workers' Compensation Claim

Medical Bills

Payment of medical bills for any treatment sought due to the injury. The employer's workers' compensation insurance will pay for all of the injured employee's medical bills regardless if the injured employee has health insurance or not. 

Weekly Paychecks

Weekly paychecks during the time the injured employee is unable to work due to the injury. In Rhode Island, a partially disabled injured employee can collect weekly paychecks for up to six years. A totally disabled employee can collect checks for even longer. 

Scarring & Disfigurement

Compensation for scarring and disfigurement that resulted from the injury sustained at work. This includes any scarring or disfigurement from surgery required to treat the injury sustained at work. 

Loss of Use

If the injury results in a permanent disability, an injured employee is entitled to compensation for the loss of use of that particular body part.
